These Terms & Conditions (the “Terms”) govern your access to and use of the website located at embracingheartshomecare.com and any related pages, content, features, or services (collectively, the “Site”). The Site is operated by Embracing Hearth Home Care, doing business as Embracing Hearts Home Care (“Company,” “we,” “us,” or “our”).

By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy (collectively, the “Agreement”). If you do not agree, do not use the Site.

1) Who We Are & What We Do

The Company provides non‑medical in‑home support services (e.g., personal care, companionship, respite care, dementia care) and related information on the Site. Any actual caregiving services are arranged under separate written service agreements and care plans, which will govern those services. These Terms cover use of the Site only and do not modify the terms of any separate client or staffing agreements.

No Medical or Emergency Advice. Content on the Site is for general information only and is not medical, nursing, or professional advice. Do not rely on Site content as a substitute for professional judgment. In an emergency, call 911 immediately.

2) Eligibility & Accounts

  • You must be at least 18 years old to use the Site.
  • If you create an account, you are responsible for safeguarding your login credentials and for all activities under your account.
  • We may refuse, suspend, or terminate access to the Site at any time, with or without notice, including for suspected violation of these Terms.

3) Acceptable Use

You agree not to:

  • Violate any applicable law or regulation;
  • Infringe the intellectual property or privacy rights of others;
  • Upload, post, transmit, or otherwise make available any content that is unlawful, harmful, misleading, defamatory, obscene, harassing, or otherwise objectionable;
  • Attempt to gain unauthorized access to the Site or related systems (including probing, scanning, or testing vulnerabilities);
  • Use any scraper, robot, spider, or other automated means to access the Site without our written permission;
  • Interfere with or disrupt the operation or security of the Site.

We may monitor use of the Site and remove or disable access to any content we reasonably believe violates these Terms.

4) Intellectual Property

The Site (including text, graphics, logos, icons, images, audio, video, and software), and all associated intellectual property rights, are owned by the Company or our licensors and are protected by copyright, trademark, and other laws. Except for the limited right to access and use the Site for your personal, non‑commercial use, no rights are granted. You may not copy, modify, distribute, sell, lease, or create derivative works based on the Site or its content without our prior written consent.

Our name, logos, and service marks may not be used without our prior written permission. Third‑party names, logos, and product/service descriptions on the Site are the property of their respective owners and their use does not imply endorsement.

5) Third‑Party Services & Links

The Site may reference or link to third‑party websites, apps, devices, or services (for example, medical alert or fall‑prevention systems). We do not control and are not responsible for third‑party sites or services, their content, or their terms and privacy practices. Your use of any third‑party product or service is at your own risk and subject to that third party’s terms.

6) Scheduling, Fees & Cancellations (Services)

Any scheduling, pricing, payments, insurance/benefit billing, cancellations, or refunds related to caregiving services will be set forth in the applicable Client Service Agreement signed with you (or your authorized representative). If there is any conflict between these Terms and a signed Client Service Agreement, the latter controls.

7) Privacy; Cookies; Communications

  • Our Privacy Policy explains how we collect, use, and share information. By using the Site, you consent to our data practices as described there.
  • The Site may use cookies and similar technologies. You can manage browser settings, but some features may not function if cookies are disabled.
  • If you provide a phone number or email, you consent to receiving communications related to inquiries, scheduling, or services. You can opt out of promotional emails at any time using the unsubscribe instructions; transactional messages may still be sent.

8) User Content & Feedback

If you submit or post content (e.g., messages, reviews, testimonials) you represent and warrant that you have all necessary rights to do so and that your content complies with these Terms. You grant the Company a non‑exclusive, worldwide, royalty‑free license to host, display, and use your content in connection with operating and improving the Site and our services. We may remove content at any time in our sole discretion.

If you provide feedback or suggestions, we may use them without restriction or compensation.

9) Disclaimers

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON‑INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR‑FREE, OR THAT DEFECTS WILL BE CORRECTED.

WITHOUT LIMITING THE FOREGOING, WE DO NOT MAKE ANY MEDICAL, NURSING, OR CLINICAL REPRESENTATIONS ON THE SITE, AND WE DO NOT WARRANT ANY THIRD‑PARTY PRODUCTS OR SERVICES REFERENCED OR LINKED ON THE SITE.

10) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE COMPANY OR ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THE SITE WILL NOT EXCEED US $100 OR THE AMOUNT YOU PAID (IF ANY) TO USE THE SITE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM—WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN SUCH CASES, THESE LIMITATIONS APPLY TO THE FULLEST EXTENT PERMITTED BY LAW.

11) Indemnification

You agree to defend, indemnify, and hold harmless the Company and our owners, officers, employees, contractors, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Site; (b) your violation of these Terms; or (c) your violation of any rights of a third party.

12) Changes to the Site or Terms

We may update the Site and these Terms from time to time. If we make material changes, we will update the “Effective Date” above and, where required by law, provide additional notice. Your continued use of the Site after changes become effective constitutes your acceptance of the updated Terms.

13) Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Texas, without regard to conflict‑of‑law rules. You consent to the exclusive jurisdiction and venue of the state and federal courts located in [Harris or Montgomery County, Texas] for any dispute arising out of or relating to these Terms or the Site. Nothing in this section limits either party’s right to seek equitable relief.

14) International Use

The Site is controlled and operated from the United States and is intended for access and use within the U.S. We make no representation that the Site is appropriate or available for use outside the U.S. Accessing the Site from territories where its content is illegal is prohibited.

15) Termination

We may suspend or terminate your access to the Site (in whole or in part) at any time for any reason. Upon termination, your right to use the Site will immediately cease, but sections that by their nature should survive (e.g., Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law) will continue to apply.
